Terms of Service

These Terms of Service govern your use of the Booklinq platform, including the operator dashboard, guest booking pages, AI-powered booking assistant, and event ticketing services. Please read them carefully.

By creating an account, listing a property or event, or completing a booking through Booklinq, you agree to these Terms.

1. Definitions

  • "Booklinq", "we", "us", "our" — the Booklinq platform and the company operating it.
  • "Operator" — a hotel owner, homestay host, villa operator, boutique property manager, tour package provider, or event organiser who lists on Booklinq.
  • "Guest" — a person who makes or attempts to make a booking through a Booklinq-powered booking page or AI assistant.
  • "Platform" — the Booklinq web application, booking pages, API infrastructure, and AI-powered messaging layer.
  • "AI Assistant" — the automated conversational booking agent that handles guest enquiries via WhatsApp and Instagram on the operator's behalf.
  • "Booking" — a confirmed reservation made by a guest for a property stay or event ticket through the platform.

2. The Booklinq Platform

Booklinq provides hospitality operators and event organisers with infrastructure to accept direct bookings from guests, without depending on third-party OTAs (Online Travel Agencies). This includes:

  • A hosted booking page for each operator's property or event
  • An AI-powered conversational booking assistant connected to the operator's WhatsApp Business number and Instagram account
  • Payment processing via Razorpay, with settlements to the operator
  • Booking confirmation, reminder, and post-stay communication flows
  • Event ticketing with QR code generation and check-in scanning
  • Operator dashboard for managing availability, pricing, bookings, and guest communications

Booklinq is a technology platform. We are not a travel agency, hotel, or event organiser. The contractual relationship for any stay or event is between the operator and the guest. Booklinq facilitates and processes the transaction.

3. Operator Accounts

3.1 Eligibility

To register as an operator, you must be at least 18 years of age, legally authorised to operate the property or event you are listing, and located in a jurisdiction where Booklinq operates.

3.2 Account Responsibilities

You are responsible for:

  • Providing accurate and complete information about your property or event
  • Keeping your listing, pricing, and availability current
  • Honouring all confirmed bookings made through the platform
  • Handling guests professionally and in accordance with applicable local laws
  • Maintaining the confidentiality of your account credentials

3.3 WhatsApp and Instagram Integration

By connecting your WhatsApp Business number and/or Instagram account to Booklinq via Embedded Signup, you authorise Booklinq to:

  • Send and receive messages on your behalf through the Booklinq AI Assistant
  • Access your message history solely for the purpose of providing contextual booking responses
  • Send automated booking confirmations, reminders, and follow-up messages to guests

You retain full ownership of your WhatsApp number and Instagram account. You can disconnect at any time from your Booklinq dashboard. Booklinq does not use your connected accounts for any purpose beyond booking facilitation.

You are responsible for ensuring your use of WhatsApp and Instagram via Booklinq complies with Meta's Terms of Service and applicable messaging laws.

3.4 Subscriptions and Fees

Access to the Booklinq platform requires a paid subscription. Subscription plans, pricing, and billing cycles are as displayed in your operator dashboard. Subscriptions renew automatically unless cancelled before the renewal date.

Booklinq may also charge a per-booking transaction fee as specified in your plan. All fees are inclusive of applicable taxes unless otherwise stated.

We reserve the right to modify pricing with 30 days' notice to active operators.

3.5 Payouts

Guest payments are processed by Razorpay. Operator settlements are made to the bank account provided during onboarding, on the settlement schedule specified in your plan. Booklinq is not liable for delays caused by banking partners, incorrect bank details provided by the operator, or circumstances beyond our reasonable control.

4. Guest Bookings

4.1 Booking Process

Guests may initiate bookings through an operator's Booklinq booking page or through the AI-powered assistant on the operator's WhatsApp or Instagram. A booking is confirmed upon successful payment.

The AI Assistant is designed to provide accurate information about availability, pricing, and property details based on the data the operator has provided to Booklinq. However, Booklinq does not guarantee the accuracy of all information presented by the AI Assistant. Guests should confirm critical details directly with the operator where necessary.

4.2 Cancellations and Refunds

Cancellation and refund policies are set by the individual operator and displayed on their booking page. Booklinq does not set these policies. Disputes regarding cancellations or refunds should be raised with the operator in the first instance. If a resolution cannot be reached, Booklinq may assist in mediation but is not obligated to issue refunds on the operator's behalf.

4.3 Event Tickets

For event bookings, Booklinq issues a QR code-based digital ticket upon payment confirmation. Tickets are non-transferable unless the operator's policy states otherwise. Lost or damaged tickets can be reissued by contacting the operator. Booklinq is not responsible for event cancellations or changes made by the operator.

5. AI-Powered Booking Assistant

Booklinq's AI Assistant is an automated system that handles guest enquiries and facilitates bookings via WhatsApp and Instagram on behalf of operators. By using the platform, both operators and guests acknowledge and agree that:

  • Responses from the AI Assistant are generated automatically and may not perfectly reflect every nuance of the operator's policies
  • The AI Assistant will escalate conversations to the operator when it cannot confidently handle an enquiry
  • Booklinq is not liable for any miscommunications, missed bookings, or losses arising from AI-generated responses
  • Conversation content processed by the AI Assistant is subject to our Privacy Policy

Operators can configure the AI Assistant's behaviour, tone, and escalation thresholds from their dashboard. Operators remain responsible for all communications sent via their connected channels.

6. Prohibited Use

You may not use Booklinq to:

  • List properties or events you do not have the legal right to operate or promote
  • Provide false, misleading, or fraudulent information
  • Process payments for goods or services outside the platform in circumvention of Booklinq fees
  • Harass, threaten, or deceive guests or other users
  • Transmit spam, malware, or unsolicited commercial messages via connected WhatsApp or Instagram accounts
  • Attempt to reverse-engineer, scrape, or otherwise interfere with the platform
  • Violate any applicable law or regulation

7. Intellectual Property

Booklinq and its underlying technology, brand, and content are the intellectual property of the company operating Booklinq. You may not copy, reproduce, or create derivative works from the platform without our express written permission.

Operators retain ownership of their property photos, descriptions, and listing content. By uploading content to Booklinq, you grant us a non-exclusive, royalty-free licence to use, display, and reproduce that content solely for the purpose of operating and promoting the platform.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Booklinq's liability for any claim arising from your use of the platform is limited to the amount you paid to Booklinq in the 3 months preceding the claim.

Booklinq is not liable for:

  • Disputes between operators and guests
  • Losses arising from operator actions or omissions
  • Inaccuracies in AI-generated responses
  • Payment processing failures or delays caused by Razorpay or banking partners
  • Force majeure events, including natural disasters, government actions, network outages, or other circumstances beyond our reasonable control
  • Indirect, consequential, or punitive damages of any kind

9. Indemnification

You agree to indemnify and hold Booklinq harmless from any claims, losses, damages, or expenses (including legal fees) arising from your use of the platform, your breach of these Terms, or your violation of any third-party rights.

10. Termination

10.1 By You

Operators may cancel their subscription at any time from the dashboard. Access to the platform continues until the end of the current billing period. Cancellation does not entitle you to a refund of fees already paid.

10.2 By Booklinq

We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or engage in behaviour that harms guests, other operators, or the platform. We will provide notice where reasonably practicable.

11. Changes to These Terms

We may update these Terms as the platform evolves. Material changes will be communicated to operators via email with 14 days' notice. Continued use of the platform after changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh, India.
